What is a "tail provision," and do you have one?

Industry-standard "tail provisions" mean sellers pay brokers even after their listing agreement ends, if the sale is to a buyer the broker found. At ECP Ventures, we find these unethical and don't use them. Instead, we offer a one-year "Performance Year" agreement with no tail, reflecting our confidence in selling any company within 150 days.
